These Terms of Service (“Terms and Conditions”) govern your use of the Safety Sign Online website and the ordering, sale, manufacture, and delivery of goods from us. By using this website, you agree to be bound by these Terms and Conditions.

1. Introduction

This website can be accessed at www.safetysignonline.co.za, related mobi-sites and software applications (the “Website”) and is owned and operated by PBS CC t/a Change Consultants trading as Safety Sign Online (“Safety Sign Online”, “we”, “us”, “our”).

These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website (“you”, “your” or “user”), including each user who registers as a customer (“registered user”).

By using the Website in any way, and/or by registering an account, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

The Website enables you to shop online for a range of goods including, but not limited to, safety signs, road signs, custom signs, and related products (“Goods”).

2. Important Notice

These Terms and Conditions apply to users who are consumers for the purposes of the Consumer Protection Act, 68 of 2008 (“CPA”).

Some clauses in these Terms and Conditions:

  • may limit the risk or liability of Safety Sign Online or a third party; and/or
  • may create risk or liability for you; and/or
  • may require you to indemnify Safety Sign Online or a third party; and/or
  • may serve as an acknowledgement of certain facts by you.

These clauses have been highlighted in context and should be carefully noted.

If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask Safety Sign Online to explain it to you before you accept these Terms and Conditions or continue using the Website.

Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit, or avoid any right or obligation created for you or for Safety Sign Online in terms of the CPA.

If you do not agree with these Terms and Conditions, you must not use the Website.

3. Returns and Refunds

Returns, exchanges, and refunds are governed by our Refund & Returns Policy, which is incorporated into these Terms and Conditions by reference and available on the Website.

Please note in particular that:

  • Timeframes for reporting defects, damages, or unwanted products are set out in the Refund & Returns Policy.
  • Custom signs and products manufactured to order generally cannot be returned or refunded unless they are defective, damaged on delivery, or not as ordered.

4. Registration and Use of the Website

  • Only registered users may place orders for Goods on the Website.
  • To register, you must provide a unique username and password and certain personal information. You are responsible for ensuring that this information is accurate and kept up to date.
  • Your username and password:
    • are for your personal use only; and
    • must not be disclosed to any third party.
  • For security purposes, you must enter your correct username and password whenever ordering Goods. If the correct details are used, we are entitled to assume that the activity is authorised by you.
  • You are responsible for all orders placed or actions taken using your account, unless you have successfully cancelled or blocked the account or notified us of suspected unauthorised use.
  • You agree to notify Safety Sign Online immediately upon becoming aware of, or reasonably suspecting, any unauthorised access to or use of your account details and to take steps to mitigate any resulting loss or harm.
  • By using the Website, you warrant that you are 18 years of age or older and have full legal capacity. If you are under 18 or not legally permitted to enter into a binding agreement, you may only use the Website under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions on your behalf.
  • You may not use any device, software or other instrument to interfere or attempt to interfere with the proper working of the Website, nor may you use any automated system (such as robots or spiders) to access the Website without our prior written consent.
  • You may not use the Website to distribute any material that is defamatory, offensive, unlawful, or amounts to hate speech.
  • You may not copy, reproduce, publish, or otherwise use the Website or its content without our prior written consent, except as allowed by law for personal, non-commercial use.

5. Conclusion of Sales and Availability of Stock

  • Registered users may place orders for Goods, which Safety Sign Online may accept or reject in its discretion.
  • Acceptance depends on factors including:
    • availability of the Goods;
    • correctness of information (including price and description); and
    • receipt of payment or payment authorisation.
  • A sale is only concluded when Safety Sign Online delivers the Goods to you or allows you to collect them. Any acknowledgement of order or payment prior to this is for information only.
  • If we reject an order, we will cancel it and refund any amounts you have already paid.
  • Because many of our products are manufactured to order, including custom signs:
    • You may cancel an order for such Goods only before it has been sent to production/manufacturing.
    • Once production has begun, cancellation and returns are governed by the Refund & Returns Policy, and returns of custom-made Goods are generally not allowed unless the Goods are defective, damaged on delivery, or not as ordered.
  • Placing Goods in a wishlist or shopping basket without completing payment does not constitute an order. Goods may change in price or become unavailable before you complete the purchase.
  • All Goods are subject to availability. We take reasonable steps to display correct stock information, but cannot guarantee real-time accuracy. If Goods become unavailable after you place an order, we will notify you and refund amounts paid for those Goods.
  • Certain Goods may not be purchased for resale. If we suspect that Goods are being purchased for resale, we may cancel your order without prior notice.

6. Payment

We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.

Payment for Goods may be made via:

  • debit card;
  • credit card;
  • direct bank deposit or electronic funds transfer (EFT);
  • Instant EFT (via approved providers).

Additional checks and authorisation procedures may apply for card payments. If we do not receive required authorisation, your order will be cancelled.

If you pay via direct deposit or EFT, payment must be made within 5 (five) days of placing your order. We will not accept or process your order until we receive proof of payment and cleared funds.

We will send email communications relating to your order and payment to the email address you provide. You may contact us at info@safetysignonline.co.za for a full record of your transaction.

7. Delivery of Goods

Safety Sign Online offers two methods of receiving your Goods:

  • Courier: Delivery to your nominated address anywhere in South Africa (delivery fees apply).
  • Self-collection: Collection from our premises in Germiston during published collection hours.

Details of delivery options, approximate timeframes (generally 7 to 10 working days for most made-to-order items), and applicable charges are set out in our Shipping Policy, which is incorporated by reference.

Where we accept your order, we will deliver the Goods to you as soon as reasonably possible, but no later than 30 (thirty) days after receipt of payment, unless otherwise agreed.

Our obligation to deliver is fulfilled once the Goods are delivered to the physical address you nominate or collected by you (or your representative). We are not responsible for loss or unauthorised use of Goods after delivery or collection has occurred.

8. Errors

We take reasonable efforts to ensure that the description, availability, pricing, and delivery charges of Goods on the Website are accurate. However, mistakes may occur.

We will not be bound by any obvious or inadvertent errors on the Website that you should reasonably have recognised as errors. In such cases, our liability is limited, where applicable, to refunding any amount already paid by you, or as otherwise provided in our Refund & Returns Policy.

Safety Sign Online is not bound by information about products displayed on any third-party website, even if the Website is linked to or from such third-party website.

9. Vouchers and Coupons

Safety Sign Online may, from time to time, make physical or electronic gift vouchers (“Vouchers”) and promotional discount codes (“Coupons”) available for use on the Website.

9.1 Vouchers

  • Purchased Vouchers are generally valid for 1 (one) year from date of issue, unless otherwise stated.
  • Complimentary or promotional Vouchers may have shorter validity periods as stated on the Voucher.
  • Vouchers cannot be used to purchase other Vouchers or exchanged for cash.
  • If your order total exceeds the Voucher value, you must pay the balance using another accepted payment method.
  • We are not responsible for loss, unauthorised use, or unauthorised distribution of a Voucher once it has been delivered to you or your nominated email address.

9.2 Coupons

  • Coupons may be issued with either a fixed discount amount (e.g. R100 off) or a percentage discount (e.g. 10% off).
  • Coupons are issued at our discretion and may be withdrawn, corrected, or cancelled at any time if misused or distributed in an unauthorised manner.
  • Unless otherwise stated:
    • each Coupon may be used once;
    • only one Coupon may be used per order; and
    • Coupons must be applied at checkout and cannot be applied retrospectively.
  • Coupons cannot be exchanged for cash, used to buy Vouchers, or refunded.
  • If a Coupon does not apply correctly at checkout, contact us before completing the order.

10. Discounted Goods and Promotions

From time to time, we may offer promotions, discounted Goods, or special offers. These are subject to their own terms and conditions, including validity periods and stock limitations.

Promotions may be withdrawn or amended at our discretion, subject to applicable law.

11. Privacy

We respect your privacy and handle your Personal Information in accordance with the Protection of Personal Information Act, 2013 (“POPIA”) and other applicable laws.

By using the Website, creating an account, requesting a quote, or placing an order, you acknowledge that you have read and understood our Privacy Policy and agree to the processing of your Personal Information as described therein.

12. Changes to These Terms and Conditions

Safety Sign Online may, in its sole discretion, change these Terms and Conditions from time to time. The updated version will be posted on the Website with an updated date.

It is your responsibility to review the Terms and Conditions regularly. If you do not agree with any changes, you must stop using the Website. Your continued use of the Website after changes are posted will be deemed your acceptance of the amended terms.

To the fullest extent permitted by law, Safety Sign Online is not liable for any loss or damage (direct or indirect) arising from your use of, or reliance on, the Website or its content, except where such loss or damage is caused by our gross negligence or wilful misconduct.

We will use reasonable endeavours to maintain the availability of the Website. However, we may suspend, withdraw, or modify all or part of the Website at any time without notice, subject to processing any orders already accepted.

If you breach these Terms and Conditions, we may suspend or terminate your access to the Website without prejudice to any other rights we may have.

19. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute arising from or in connection with them, are governed by the laws of the Republic of South Africa.

You consent to the non-exclusive jurisdiction of the South African courts in respect of any proceedings arising out of or in connection with these Terms and Conditions, without limiting your rights under the CPA to approach any other competent forum.

22. General

  • We may, in our sole discretion, at any time and for any reason, suspend or terminate the operation of the Website or your right to use it, subject to honouring any accepted orders.
  • You may not cede, assign, or transfer your rights and obligations under these Terms and Conditions without our prior written consent.
  • If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No failure or delay by either party in exercising any right under these Terms and Conditions will constitute a waiver of that right.
  • These Terms and Conditions, together with the policies referenced herein (including the Refund & Returns Policy, Shipping Policy, and Privacy Policy), constitute the entire agreement between you and Safety Sign Online regarding your use of the Website and the purchase of Goods.
